Terms of Service
General Terms and Conditions
1. Scope
These Terms, together with the agreement concluded during registration, govern the relationship between SmartEdge Trading (the “Provider”) and the customer (the “Customer”) in the version valid at the time of order. Conflicting customer terms are not accepted.
A Customer is a consumer if the services are used mainly for non-commercial purposes; otherwise, the Customer is deemed a business user.
2. Definitions
“SmartEdge EA” is automated trading software. It requires the Customer to use their own brokerage account, install the software on a suitable device with continuous internet access, and (for optimal operation) select a leverage of 1:200.
3. Service Description
- Software access. SmartEdge EA is offered independently of any academy account and remains fully usable while the Customer holds a valid license. After a license expires, SmartEdge EA will maintain existing positions and, where necessary, open hedging trades solely to protect those positions.
- No advice / no financial services. The Provider does not offer investment advice in any channel (e.g., videos, calls, chat groups) and does not conduct payments, banking, or securities transactions for Customers. The Provider does not trade Customer funds and has no access to Customer accounts.
- Risk notice. Trading foreign exchange and related instruments involves significant risk and may result in substantial losses. Markets are volatile and unpredictable.
- Software disclaimer. The software is built with due care but no guarantee is made that outputs are always correct. Use is at the Customer’s own risk; the Customer is solely responsible for inputs, execution, and any resulting losses.
- Partner disclosure. The Provider collaborates with Pacific Union Ltd, RoboForex Ltd, EagleFX Ltd, Hugo’s Way Ltd and with Hostwinds LLC for servers. Affiliate links may generate commissions; such cooperation is labeled as advertising.
4. License and Account Access
- Upon full payment of the applicable fee, the Customer receives a non-exclusive, non-transferable, non-sublicensable license to use the software and training content for the duration of the selected plan.
- If a refund is granted under §5(4), the license terminates upon refund.
- The Customer may download information for private use and retain it without time limit.
- Sharing credentials, sublicensing, reselling, renting, public distribution, editing, or decompiling the software is prohibited unless the Provider gives prior written consent.
- Any breach voids granted rights; use must cease immediately. The Provider may block accounts without prior notice.
5. Fees
- Fees depend on the selected package (see http://smartedgetrading.net) and are gross prices including applicable VAT.
- Payment is due on the booking date; on renewal under §7, fees are due at the start of the new term.
- Billing is processed via external payment providers (Copecart or Stripe) with automatic collection.
- Money-Back Guarantee (SmartEdge EA). Within 14 days of initial registration, if realized trades result in an account balance lower than the initial deposit, the Customer may request a refund by emailing the Provider. Refunds are made via the original payment method. The guarantee applies only if SmartEdge EA is installed and used under the conditions specified by SmartEdge Trading and the relevant broker.
6. Protection of Services
The Customer must protect software and access data from unauthorized use, keep passwords confidential and secure, and not share credentials (except with password-manager providers or brokers).
7. Term and Termination
- Plans: 1-Month Trial, 3-Month, and 1-Year.
- 1-Month Trial. Runs for one month and ends automatically at expiry. It does not renew; continued use requires upgrading to a paid plan. After expiry, only the limited post-term functionality in §3(a) remains.
- 3-Month plan. Runs for three months and renews every three months unless canceled at least 7 days before the end of the term. After expiry, only the limited post-term functionality in §3(a) remains.
- 1-Year plan. Runs for twelve months and renews annually unless canceled at least 7 days before the end of the term. After expiry, only the limited post-term functionality in §3(a) remains.
- Either party may terminate for good cause without notice (e.g., material misuse of services, cessation of operations/services in §3). Reference is made to §543 BGB.
- Termination may be submitted via the service platform or by email; receipt by the Provider governs timeliness.
- Upon termination, use must cease. Exported files may be retained. Accounts are blocked and stored data deleted unless legal retention duties apply. See the privacy policy for details.
8. Warranty
- The Provider warrants that the agreed service quality (§2) is maintained during the term and that no third-party rights prevent contractual use. Material and legal defects will be remedied within a reasonable time.
- Defects must be reported promptly with details (time and circumstances) via the offered contact options (e.g., the support contact listed on the website, Telegram, or WhatsApp).
9. Miscellaneous
- Customer terms do not apply.
- All annexes referenced in this agreement form part of the contract.
